CBSA INVESTIGATING FORGED GRINDING MEDIA

ALLEGED DUMPING OF FORGED GRINDING MEDIA FROM CHINA

On January 9, 2026, the Canada Border Services Agency (“CBSA”) issued a Notice of Initiation of Investigation under the Special Import Measures Act (“SIMA”) in respect of the alleged dumping of forged grinding media originating in or exported from the Peoples’s Republic of China (“China”).  This investigation was prompted by a complaint filed by Moly-Cop Canada.

The investigation continues a trend by the CBSA of scrutinizing imports from China, which continues to be the jurisdiction with highest number of Anti-Dumping and Countervailing duty orders.

SIMA RELIEF FOR SMALL SOLAR MODULES?

CITT CONSIDERING REQUEST FOR EXCLUSION FROM SIMA DUTIES

On December 11, 2025, the Canadian International Trade Tribunal (CITT) announced the commencement of an interim review regarding its existing order imposing Anti-Dumping Duties (“ADDs”) and Countervailing Duties (“CVDs”) on certain Photovoltaic Modules and Laminates from China.  The review will consider introducing an exclusion to the definition of Subject Goods which would effectively remove Anti-Dumping Duties from a narrow subset of Chinese solar panels.

Below, we explain what interim reviews are and why they are a useful tool to ensure that Canada gains from global innovation while protecting its domestic industry from unfair foreign competition.

IMPORTING CHINESE STEEL HAS COSTLY CUSTOMS DIMENSIONS

While the recent focus in Canada has been on the tariff war between Canada and the US (for example, President Trump's tariffs on certain imported Canadian steel, and Prime Minister Carney's retaliatory surtaxes on same), what many have overlooked are similar Canadian surtaxes on Chinese steel and aluminum, which pre-date both.

As a number of Canadian importers have figured out, importing Chinese steel comes at a very significant cost on two different fronts.

PROVISIONAL DUTIES ON STEEL STRAPPING

CBSA IMPOSES PROVISIONAL DUTIES ON CHINA, SOUTH KOREA, TURKEY, AND VIETNAM

On September 16, 2025, the Canada Border Services Agency (“CBSA”) released a notice of its preliminary determination of dumping in respect steel strapping originating in or exported from China, South Korea, Türkiye (Turkey), and Vietnam, and the subsidizing of steel strapping from China (the “Subject Goods”).

Provisional duties are now imposed on imports of the Subject Goods released from the CBSA on or after September 16, 2025!

EXPIRY REVIEW: STEEL SHEET 2

CITT REVIEWING ANTI-DUMPING DUTIES ON STEEL SHEET FROM TURKIYE & VIETNAM

On September 9, 2025, the Canadian International Trade Tribunal (the “CITT”) issued a noticethat it was beginning an expiry review in respect of corrosion-resistant steel sheet 2 originating in or exported from the Republic of  Türkiye and the Socialist Republic of Vietnam (the “Subject Goods”).  On September 10, 2025, the Canada Border Services Agency (“CBSA”) similarly gave notice of the initiation of their parallel expiry review investigation.

EXPIRY REVIEW: STEEL PLATE FROM UKRAINE

CITT REVIEWING ANTI-DUMPING DUTIES

On August 5, 2025, the Canadian International Trade Tribunal (“CITT”) issued a notice that it was beginning an expiry review in respect of hot-rolled carbon steel plate and high-strength low-alloy steel plate originating in or exported from Ukraine (the “Subject Goods”).  On August 6, 2025, the Canada Border Services Agency (“CBSA”) similarly gave notice of the initiation of their parallel expiry review investigation.

CBSA INVESTIGATING CAST IRON SOIL PIPE!

DUMPING & SUBSIDIZING OF CAST IRON SOIL PIPE FROM CHINA

On July 11, 2025, the Canada Border Services Agency (“CBSA”) issued a Notice of Initiation of Investigation under the Special Import Measures Act (“SIMA”) in respect of the alleged dumping and subsidizing of cast iron soil pipe from China.  This investigation was prompted by a joint complaint filed by Canada Pipe Company ULC, d/b/a Bibby-Ste-Croix.

The goods under investigation are more specifically described as: 

Cast iron soil pipe originating in or exported from the People’s Republic of China, whether finished or unfinished, regardless of industry or proprietary specifications, and regardless of wall thickness, length, surface finish, end finish, or stenciling, having a nominal outside diameter from 1.5 inches to 18 inches. Cast iron soil pipe is non-malleable iron pipe of various designs and sizes, including but not limited to both hub-less and hub and spigot cast iron soil pipe (the “Subject Goods”).

CBSA PRELIMINARY FACTS: NO CIRCUMVENTION!

PRELIMINARY ASSESSMENT ON CONTAINER CHASSIS FROM VIETNAM

On April 9, 2025, the Canada Border Services Agency (“CBSA”) released a Statement of Essential Facts (“SEF”) related to its first-ever anti-circumvention investigation with respect to whether container chassis originating from Vietnam are circumventing Canada’s trade remedy measures on container chassis from China.
