CBSA IMPOSES PROVISIONAL DUTIES ON CAST IRON SOIL PIPE FROM CHINA

On October 9, 2025, the Canada Border Services Agency (“CBSA”) released a notice of its preliminary determination of dumping in respect cast iron soil pipe originating in or exported from the People’s Republic of China (the “Subject Goods”).

Provisional duties are now imposed on imports of the Subject Goods released from the CBSA on or after October 9, 2025!

EXPORTERS TO THE US MAY HAVE LOST THEIR WAY RELYING ON CHINESE IMPORTS

We recently had a file come across our desk where a Canadian company was trading in Chinese products and marginally manufacturing them for export to the United States (US).  The company ultimately came under scrutiny from the United States Customs and Border Protection (US CBP) concerning potential duties.  But not the kind of "duties" that everyone is concerned with today (i.e., neither the "Trump Tariffs" or Canada's "Retaliatory Tariffs").

USCBP was concerned with Anti-Dumping and Countervailing Duties on the Chinese goods – totalling almost 200% based on the landed cost of the goods being exported to the US from Canada.

CBSA INVESTIGATING "PET" RESIN AGAIN

POLYETHYLENE TEREPHTHALATE ("PET") RESIN FROM CHINA & PAKISTAN

On March 19, 2025, the Canada Border Services Agency (“CBSA”) issued a Notice of Initiation of Investigation under the Special Import Measures Act (“SIMA”) in respect of the alleged dumping polyethylene terephthalate (“PET”) resin originating in or exported from the People’s Republic of China and the Islamic Republic of Pakistan, and the subsidizing of PET resin originating in or exported from China.   This investigation was prompted by a manufacturer of similar goods in Quebec.

The goods under investigation are more specifically described as: 

On February 10, 2025, the Canadian International Trade Tribunal (the “CITT”) issued a notice that it was beginning an expiry review in respect of certain Hot-Rolled Carbon Steel Plate and high-strength low-alloy steel plate originating in or exported from Brazil, Denmark, Indonesia, Italy, Japan, and South Korea (the “Subject Goods”).  On February 11, 2025, the Canada Border Services Agency (the “CBSA”) similarly gave notice of the initiation of their parallel expiry review investigation (in respect of “Hot-rolled carbon steel plate 7”).

On January 13, 2025, the Canadian International Trade Tribunal (the “CITT”) announced its Finding in Inquiry NQ-2024-003 (the “Finding”) reporting that the dumping of certain hot-rolled deformed steel concrete reinforcing bar in straight lengths or coils, commonly known as rebar, originating in or exported from the Republic of Bulgaria (Bulgaria), the Kingdom of Thailand (Thailand), and the United Arab Emirates (UAE) (the “Subject Goods”) had caused injury to the domestic industry.

New Anti-Dumping Duties (“ADDs”) now apply to certain Subject Goods imported into Canada and released after January 13, 2025.

On November 25, 2024, the Canadian International Trade Tribunal (the “CITT”) issued a notice that it was beginning an expiry review in respect of certain Aluminum Extrusions originating in or exported from the People’s Republic of China (the “Subject Goods”).  On November 26, 2024, the Canada Border Services Agency (the “CBSA”) similarly gave notice of the initiation of their parallel expiry review investigation.

On October 7, 2024, the Canadian International Trade Tribunal (the “CITT”) issued a notice that it was beginning an expiry review in respect of certain hot-rolled carbon steel plate and high-strength low-alloy steel plate originating in or exported from the Republic of Bulgaria, the Czech Republic and Romania (the “Subject Goods”).  On October 8, 2024, the Canada Border Services Agency (the “CBSA”) similarly gave notice of the initiation of their parallel expiry review investigation.

On June 6, 2024, the Canada Border Services Agency (“CBSA”) released a notice of its preliminary determination of dumping in respect of certain wire rod originating in, or exported from, China, Egypt and Vietnam. 

Provisional duties are now imposed on imports of the Subject Goods released from the CBSA on or after June 6, 2024!

On May 7, 2024, the Canadian International Trade Tribunal (the “CITT”) issued a preliminary determination of injury, concluding that there was evidence that the alleged dumping of certain wire rod from China, Egypt and Vietnam has caused material injury to the domestic industry.

Background Information

On March 11, 2024, following the initiation of an anti-dumping investigation by the Canada Border Services Agency (the “CBSA”), the CITT initiated a preliminary injury inquiry in respect of alleged dumping of wire rod, which we covered in a previous blog post. 

On May 13, 2024, the Canadian International Trade Tribunal (“CITT”) issued a notice that it was beginning an expiry review in respect of unitized wall modules originating in or exported from the People’s Republic of China (“Subject Goods”).  On May 14, 2024, the Canada Border Services Agency (“CBSA”) similarly gave notice of the initiation of their parallel expiry review investigation.

The Subject Goods are defined as follows:

On May 3, 2024, the Canada Border Services Agency (“CBSA”) issued a Notice of Initiation of Investigation under the Special Import Measures Act (“SIMA”) in respect of the alleged dumping of certain concrete reinforcing bar from Bulgaria, Thailand and the UAE.  This investigation was prompted by a joint complaint filed by three steel manufacturers.

The goods under investigation are more specifically described as:

On March 8, 2024, the Canada Border Services Agency (“CBSA”) issued a Notice of Initiation of Investigation under the Special Import Measures Act (“SIMA”) in respect of the alleged dumping of certain wire rod from China, Egypt, and Vietnam.  This investigation was prompted by a complaint filed by an Ontario manufacturer. 

The goods under investigation are more specifically described as: 

Certain hot‐rolled wire rod of carbon steel and alloy steel of circular or approximately circular cross section, in coils, equal to or less than 25.5 mm in actual solid cross‐sectional diameter, originating in or exported from the People’s Republic of China, the Arab Republic of Egypt and the Socialist Republic of Vietnam (the “Subject Goods”). 

On January 18, 2024, the Canada Border Services Agency (“CBSA”) issue a Notice of Conclusion in the ongoing Expiry Review of Carbon Steel Welded Pipe 2 (“CSWP-2”) exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (“Chinese Taipei”), India, Oman, South Korea, Thailand and the UAE (“Subject Goods”). The CBSA determined that the expiry of the Canadian International Trade Tribunal’s (“CITT”) order dated October 15, 2018, in Expiry ReviewRR‑2017‑005, is likely to result in the continuation or resumption of (i) dumping of Subject Goods (from all the above-noted countries) and (ii) subsidizing of Subject Goods (exported from India). A detailed Statement of Reasons for this determination was released on February 02, 2024.

Canada’s furniture industry was seemingly upturned in late 2020 with the Canada Border Services Agency (“CBSA”) investigation and then its Notice of Preliminary Determination that certain upholstered domestic seating (“UDS”) being imported to Canada from China and Vietnam was being dumped.  Almost overnight, it seemed, the cost of Canadian leather sofas and recliners skyrocketed (some under dumping and subsidy duties set as high as 188%) – with CBSA’s imposition of provisional and then final anti-dumping duties, levied under Canada’s Special Import Measures Act (“SIMA”), being to blame.   (Canadian industry might suggest NOT “to blame” BUT to “protect”, Canadian competitiveness that is).

On August 21, 2023, the Canadian International Trade Tribunal (“CITT”) announced an Expiry Review of its finding made on October 15, 2018, in Expiry Review RR-2017-005, continuing its finding made on December 11, 2012, in Inquiry No. NQ-2012-003 in respect of Carbon Steel Welded Pipe exported from Chinese Taipei, the Republic of India, the Sultanate of Oman, the Republic of Korea, the Kingdom of Thailand and the United Arab Emirates.

On January 23, 2024, the CITT released a Revised Notice of Expiry Review RR-2023-003, updating certain elements of the Expiry Review Schedule.  Relevant Questionnaires have also been posted.
